Throughout these Terms, “Sub Zero”, “we”, “us” and “our” refer to Sub Zero Technology Limited.

By placing an order with us, you agree to these Terms together with our applicable policies, including our Shipping Policy, Return and Refund Policy and Privacy Policy.

Nothing in these Terms affects your statutory rights as a consumer.

2. Our Online Store

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell products to you.

You must use our website only for lawful purposes.

You must not attempt to interfere with the operation or security of the website, introduce malicious software, gain unauthorised access to our systems or use the website in a way that infringes the rights of another person.

3. Who Can Place an Order

You must be legally capable of entering into a contract to place an order with us.

If you are under 18, you should have the permission of a parent or guardian before purchasing from our website.

Certain products may be subject to additional legal, carrier or delivery restrictions.

4. Placing an Order and Contract Formation

When you place an order through our website, you are making an offer to purchase the products in your order.

After you place an order, we will normally send you an email acknowledging that we have received it. This order acknowledgement does not mean that we have accepted your order.

Unless we expressly tell you otherwise, a contract between you and Sub Zero Technology Limited is formed when we accept your order by dispatching the goods to you.

Once your order has been dispatched, we will normally send you a dispatch confirmation email.

5. Our Right to Refuse or Cancel an Order

We reserve the right to refuse or cancel an order before it has been accepted.

Reasons may include:

  • a product being unavailable;
  • an incorrect price or product description;
  • an error in stock availability;
  • payment not being authorised;
  • suspected fraud or misuse;
  • delivery restrictions;
  • legal or regulatory restrictions;
  • restrictions relating to hazardous or restricted products;
  • unusually large quantities; or
  • circumstances where we are unable reasonably to fulfil the order.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products and any applicable delivery charges.

6. Product Availability

All products are subject to availability.

We operate an inventory system intended to keep our online stock levels accurate, but occasionally a product may become unavailable after an order has been placed.

We also inspect products during packing. If we discover that a product is damaged, defective or otherwise unsuitable for dispatch and we do not have suitable replacement stock, we will contact you.

Where we cannot supply a product you have ordered, we may offer an alternative where appropriate, but you will not be required to accept it.

If we cannot fulfil the order, we will refund the amount paid for the unavailable product.

7. Product Information

We take reasonable care to ensure that product descriptions, photographs, specifications, dimensions and other information displayed on our website are accurate.

However, minor variations may occur.

Colours may appear slightly different depending on your device, display settings and lighting. Product packaging may also change from time to time without affecting the product itself.

For products manufactured by third parties, specifications may occasionally be changed by the manufacturer.

Where a specification, measurement or feature is particularly important to your purchase, please contact us before ordering if you require confirmation.

Nothing in this section reduces your statutory rights where goods do not match their description.

8. Pricing

Product prices are displayed on our website and may change from time to time.

Changing the price of a product will not affect an order that we have already accepted, except where there has been an obvious pricing error.

We take reasonable care to ensure prices are correct. However, pricing errors can occasionally occur.

If we discover an obvious pricing error before accepting your order, we may contact you to give you the opportunity to purchase the product at the correct price or cancel the affected item.

We are not required to supply a product at an obviously incorrect price where the pricing error should reasonably have been apparent.

9. VAT

Prices displayed to UK consumers include VAT where applicable, unless clearly stated otherwise.

For international orders, the treatment of UK VAT and any overseas import VAT, customs duties or other charges will depend upon the destination and applicable rules.

10. Payment

You must pay for your order using one of the payment methods offered at checkout.

Available payment methods may include Shopify Payments, Shop Pay and PayPal.

Payment is subject to authorisation by the relevant payment provider.

We reserve the right not to dispatch an order until payment has been successfully authorised.

11. Delivery

We use Royal Mail, UPS and other delivery partners where appropriate.

Available delivery methods, prices and estimated delivery times are displayed during checkout or explained in our Shipping Policy.

Delivery estimates are not guaranteed unless the particular delivery service is expressly described as guaranteed.

You are responsible for providing a complete and accurate delivery address.

Our Shipping Policy provides further information about dispatch times, delivery services, tracking, missed deliveries, refused and uncollected parcels, incorrect addresses, international delivery and customs and import charges.

12. Risk and Ownership

Responsibility for the goods passes to you when the goods are delivered to you or to a person identified by you to receive them.

Ownership of the goods passes to you once we have received payment in full.

Nothing in this section affects your rights if goods are lost or damaged before they are delivered to you.

13. Your Right to Cancel

If you are a consumer purchasing online, you will normally have a statutory right to cancel qualifying purchases under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

For most qualifying goods, you have 14 days after receiving the goods to notify us that you wish to cancel, followed by a further 14 days to return the goods.

Exceptions apply to certain products, including some personalised, customised or specially altered goods.

14. Our 180-Day Returns Policy

In addition to your statutory rights, we currently offer a voluntary 180-day returns period for eligible products.

Conditions apply to returns made outside the statutory cancellation period.

Our voluntary returns policy does not replace or restrict your statutory consumer rights.

15. Faulty or Misdescribed Goods

Products we supply must comply with your statutory rights, including the requirements of the Consumer Rights Act 2015.

Goods must, where applicable, be:

  • of satisfactory quality;
  • fit for their intended purpose; and
  • as described.

If you believe a product is faulty, damaged or not as described, please contact us.

Any product guarantee or voluntary returns arrangements we provide are in addition to your statutory rights and do not replace them.

16. Restricted Products

Some products, including gas canisters and other restricted or hazardous goods, may be subject to carrier, destination or legal restrictions.

We may be unable to send certain products using particular delivery services or to particular destinations.

Available delivery options will normally be determined at checkout.

If you are unsure whether we can deliver a particular product to your address, please contact us before ordering.

17. International Orders

Customers placing orders for delivery outside the UK are responsible for ensuring that products ordered can lawfully be imported into the destination country.

Unless otherwise stated at checkout, we do not currently collect overseas import VAT, customs duties or customs clearance charges on your behalf.

The recipient may therefore be required to pay import VAT, customs duties, carrier clearance fees or other charges before the parcel can be delivered.

18. Customer Accounts

If you create an account on our website, you are responsible for keeping your login details secure.

You should provide accurate and current information and notify us promptly if you believe your account has been accessed without your permission.

We may suspend or restrict an account where we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.

19. Customer Reviews

We use Judge.me to help collect and display customer reviews.

If you submit a review, you confirm that:

  • it reflects your genuine experience or opinion;
  • it does not contain knowingly false or misleading information;
  • it does not infringe another person's intellectual property or privacy rights;
  • it is not defamatory, threatening, abusive, obscene or unlawful; and
  • you have the right to submit any photographs or other content included with your review.

You retain ownership of content you submit.

By submitting a review, photograph or other content for publication on our website, you give Sub Zero Technology Limited a non-exclusive, royalty-free licence to display, reproduce and use that content for the purpose of operating, promoting and marketing our business and products.

We may moderate, decline to publish or remove content where we reasonably believe it breaches these Terms, is unlawful, contains personal information that should not be published, is spam or is otherwise inappropriate.

We will not remove or suppress a genuine negative review merely because it is unfavourable.

20. Intellectual Property

Unless otherwise stated, the content of our website—including text, photographs, graphics, logos, designs, product descriptions and other materials—is owned by or licensed to Sub Zero Technology Limited and is protected by applicable intellectual property laws.

You may access and use our website for your own personal and lawful use.

You must not reproduce, republish, commercially exploit or distribute substantial parts of our website content without our prior permission, except where permitted by law.

Third-party brand names and trademarks displayed on our website remain the property of their respective owners.

21. Third-Party Websites and Services

Our website may contain links to third-party websites or use services provided by third parties.

We are not responsible for the content, availability or privacy practices of independent third-party websites.

Where you choose to purchase goods or services directly from another business, that transaction will be governed by the terms applicable between you and that business.

This does not affect our responsibility for products you purchase directly from Sub Zero Technology Limited.

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach of contract or our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not reasonably foreseeable.

As this website is intended for consumer purchases, we are not responsible for business losses such as loss of profits, loss of business, loss of opportunity or business interruption arising from a purchase made as a consumer.

Nothing in these Terms affects your statutory consumer rights.

25. Events Outside Our Reasonable Control

We are not responsible for delays or failures caused by circumstances outside our reasonable control.

These may include severe weather, natural disasters, transport disruption, industrial action, interruption of postal or courier networks, telecommunications failures, government action or other events that we could not reasonably prevent.

This does not affect rights you may have under consumer law, including rights relating to delivery within an agreed or legally required period.

26. Privacy and Personal Information

We collect and process personal information in accordance with our Privacy Policy and applicable UK data protection law, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Our Privacy Policy explains what personal information we collect, why and how we use it, the lawful bases on which we process it, who we may share it with, how long we retain it and your data protection rights.

Where our website uses non-essential cookies and similar technologies, these are managed in accordance with your choices through our cookie/privacy controls where consent is required.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, services or applicable law.

The Terms that apply to your purchase will normally be those in force when you place your order.

Changes made after we have accepted an order will not retrospectively alter the contractual terms applying to that order unless required by law or agreed with you.

The latest version of these Terms will be published on our website together with the date on which it was last updated.

28. If Part of These Terms Is Invalid

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed or limited to the minimum extent necessary.

The remaining provisions will continue to apply.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

These Terms are between you and Sub Zero Technology Limited.

Unless expressly stated otherwise, no other person has a right to enforce these Terms.

31. Governing Law and Jurisdiction

These Terms and any contract between you and Sub Zero Technology Limited are governed by the laws of England and Wales.

If you live in Scotland or Northern Ireland, you will retain any mandatory consumer protections available to you under the laws applicable where you live.

If you live in England or Wales, legal proceedings relating to these Terms may be brought in the courts of England and Wales.

If you live in Scotland, legal proceedings may generally be brought in either the Scottish courts or the courts of England and Wales.

If you live in Northern Ireland, legal proceedings may generally be brought in either the Northern Irish courts or the courts of England and Wales.
